February 25, 2014
Federal contractors have already braced themselves for changes coming on March 24, 2014. But, in light of a posting compliance development, all employers may need to prepare for a (small) change.
New regulations issued by the Office of Federal Contract Compliance Programs (OFCCP) will go into effect on March 24, 2014, affecting covered federal contractors. The regulations will require them to set benchmarks for hiring veterans and individuals with disabilities, as specified under the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) and Section 503 of the Rehabilitation Act.
Due to these new regulations, the Department of Labor has stated that the "Equal Employment Opportunity is the Law" poster will likely be revised. The Equal Employment Opportunity Commission (EEOC) is working with the OFCCP to determine if the poster needs to undergo any necessary changes regarding its wording on VEVRAA.
While the regulations themselves only affect federal contractors, all employers should take note of this potential change. As of now, there's only one version of the "Equal Employment Opportunity is the Law" poster. It's possible that a separate posting may be created for federal contractors only; however, if the original poster undergoes any changes, the EEOC and OFCCP may issue a mandatory update for all employers.
We’re monitoring the situation closely and will keep you updated on any new developments with the posting as we approach the March 24, 2014 deadline.
